Ones property enters probate when a person dies without any proper will or no will resulting in ambiguous beneficiaries for the property. The probate cases can be taken up by attorneys or executors. Attorneys are the people who take up these cases and are experienced or specialized in these cases. The attorneys usually charge much and usually it is some percentage of the estate under consideration. Executor is the person who usually carries out the deceased ones wish as per the will that he had left. Usually the executor is selected by the deceased while he was alive to carry on the process of distributing property. The executor usually handles the will or the trust of the deceased as well and he would be someone who is not related to the property and also to the deceased. The executor might in turn go for an attorney to carry out the process of settling the property to the beneficiaries.

Though every probate might be unique when compared to the other there are certain steps which are common to all the probate cases. One such process is appointing a proper executor to carry out the process. Final step is also the same like discharging the executor from all his duties related to the will or the trust, so that he can continue with his work. Executor role is more powerful only when there is a valid will or trust which can be taken over to the court for further proceedings and proper sharing of property.
