Probate also does the job of identifying and inventorying the decedent’s property. The probate has to take up the appraisal of the property of the dead person. The tax that might have to be paid by the deceased as per the estate that he owns is also calculated by the probate. The distribution of property according to the will of the deceased person is also done by the probate. Probate attorney can take up the job of attending the proceedings and court appearance that might be required. Usually people go for the option of choosing an attorney since the process is simpler and the attorney would take up the job and finish it as per law. The attorney charge might be more when compared to the executor and also the attorneys usually charge a percentage of the estate that the beneficiaries receive.

The percentage of share of each person again depends on the will of the deceased. If there is no will produced by the deceased then the share is calculated based on the formula stated in the law. This would result in proper distribution of estate even if there is now will.
